Terms of Participation – Birch Hunting Season Giveaway

1. Eligibility

The Birch Spring Season Giveaway (“Giveaway”) is open to legal residents of the United States who are 18 years of age or older at the time of entry. Employees of Birch, its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members of each are not eligible to participate.

2. Entry Period

The Giveaway begins on January 30, 2026 and ends at 11:59 PM PST on February 22, 2026. Entries received outside this period will not be considered.

3. How to Enter

Individuals may enter the Giveaway in one of two ways:(a) via an eBike purchase at birchhunters.com, or (b) by completing a free online entry form.

A. Qualified Purchase: To enter, person may complete a qualified purchase of any Birch Hunters electric bicycle listed on the website. By making a qualified purchase at birchhunters.com, Participant will receive one (1) entry submission per purchase.

B. NO PURCHASE NECESSARY – Online Method of Entry:  To participate in the Giveaway without making a purchase, Participant may sign up for the Giveaway by completing the form on Birch's Gleam Link. By signing up via Birch's Gleam and completing the form, Participant will receive one (1) entry submission per completed form and actions.

Automated or fraudulent methods of entry are not permitted and will result in disqualification. No purchase necessary to enter or win. A purchase does not increase your chances of winning. Registered Gleam entrants are automatically entered into the Grand Prize.

4. Consent for Marketing Communications

By entering this Giveaway, participants expressly consent to be added to Birch’s marketing email list. Participants may unsubscribe at any time via the link provided in Birch’s email communications.

5. Prizes

Winners will be selected at random and will receive the following prizes:

• 1(s) winner will receive Birch eBike (Direwolf) + Birch Care Package (approximate retail value 4699 USD)
  
  
• 1 winner(s) will receive Vortex Crossfire HD 1400 Rangefinder + Birch Camo Bow Hunting Backpack + Birch Care Package (approximate retail value 450 USD)

Actual/appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except for at the Sponsor's discretion. The prize is non transferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. Acceptance of the prize constitutes permission for the Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Prizes are non-transferable and no substitution will be made except as provided by Birch in the event of unavailability. All prize-related expenses, including but not limited to taxes, shipping, and handling, are the sole responsibility of the winners.

6. Winner Selection and Notification

Winners will be selected through a random drawing conducted within 24 hours of the entry deadline. Winners will be announced on birchhunters.com and @birchhunters on Instagram by February 27, 2026. Winners will also be notified by email.

If a winner cannot be contacted, fails to respond within 5 days, or is disqualified for any reason, Birch reserves the right to select an alternate winner.

7. Consent for Use of Likeness

By accepting a prize, winners grant Birch the irrevocable right to use their name, likeness, photo, story, or any other provided content in promotional materials, including Birch’s website, email campaigns, and social media platforms, without further compensation or permission, except where prohibited by law.

8. General Conditions

Birch reserves the right to cancel, suspend, or modify the Giveaway if fraud, technical failures, or any other factor beyond Birch’s control impairs the integrity of the promotion. Birch also reserves the right to disqualify any individual found to be tampering with the entry process or violating these Terms of Participation.

9. Limitation of Liability

By entering, participants release and hold harmless Birch and its affiliates, subsidiaries, partners, employees, and agents from any liability, injury, loss, or damage resulting from participation in the Giveaway or acceptance, possession, use, or misuse of any prize.

10. Governing Law

This Giveaway is governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Orange County, California.
