Birch LIMITED WARRANTY (U.S.)
IMPORTANT NOTICE UNDER THE MAGNUSON-MOSS WARRANTY ACT (15 U.S.C. §2301 et seq.; 16 C.F.R. Parts 700-703)
This document states the full terms of the written warranty for Birch-branded consumer products sold in the United States. It is a Limited Warranty as defined by federal law.
- Warrantor and Contact

- Products Covered
This Limited Warranty covers new, genuine Birch-branded consumer products purchased from Birch or an authorized reseller and delivered within the United States.
- Warranty Period
Lifetime warranty for structural components (e.g., frame); two (2) years for electrical components (e.g., motor, battery, throttle, PAS control panel, controller, wiring harness, front light, rear light, sensor, and charger); and one (1) year for other components (e.g., suspension fork, stem, handlebar, headset, brake, bottom bracket, crankset, pedal, kickstand, rim, hub, freewheel, cassette, derailleur, and shifter), from the date of original retail purchase by the first consumer purchaser.
- What This Warranty Covers
Defects in materials and workmanship of the covered product under normal, intended, household use during the Warranty Period.
- What BirchWill Do
(1) At our option and at no charge to you, we will:
(a) provide replacement parts or assist you in purchasing parts;
(b) replace the product with a new product of the same model, the same price, or a higher price (only if the original product is out of stock or discontinued);
(c) refund the actual price you paid for the product upon its return (we may deduct discounts, installation fees, and other fees you paid to third parties); or
(d) authorize a designated service provider to perform the repair.
(2) Any replaced product or part becomes our property.
(3) Repairs and replacements are warranted for the remainder of the original Warranty Period.
We reserve the right to reasonably interpret and apply the terms of this warranty, subject to applicable federal and state laws.
- How to Obtain Warranty Service
(a) Contact us using the information in Section 1 (or contact the seller) and provide: purchase date, seller, order number, product model, description of the issue, and photos/videos if available.
(b) Follow our troubleshooting and return instructions.
(c) If return is authorized, we will provide an RMA and instructions. For approved claims, we will provide a prepaid ground shipping label for the return and will cover the return shipping back to you.
(d) You must remove personal data and accessories not originally supplied. We are not responsible for loss of data or removable media.
- Consumer Responsibilities
(1) Provide proof of purchase from an authorized source and evidence of product failure, damage, or other non-functionality.
(2) Use and maintain the product as described in the user manual.
(3) Comply with return, packaging, and RMA instructions.
(4)Packaging:
(a) We do not provide packaging free of charge (including outer cartons, protective fillers/dunnage used to secure the goods, or pallets).
(b) You may use the original packaging or, with assistance from our customer service team, obtain packaging that meets our requirements.
(c) For any packaging you purchase yourself, we will not return such packaging after we receive the goods, and we do not cover the cost of that packaging.
(5) If your device is password-protected, you must remove the password before return or provide the password to us so that we can complete diagnosis and service.
- What This Warranty Does Not Cover
(a) Damage from misuse, abuse, neglect, accidents; improper installation, improper storage, or operation/maintenance inconsistent with the official Assembly Instructions and Owner’s Manual; exposure to liquids (unless rated), chemicals, abrasives, sand, dirt, or other abnormal environments; unauthorized repairs or modifications; use with non-recommended or incompatible power supplies, battery chargers, accessories, or peripheral equipment; commercial or rental use if the product is marketed solely for consumer use; ordinary wear and tear and consumable parts; cosmetic or surface damage (such as scratches, dents, or corrosion) that does not affect functionality; or external/environmental causes including but not limited to collision, fire, flooding, windstorm, lightning, earthquake, theft, or abnormal physical/electrical/electromechanical stress.
For clarity:
- Misuse or abuse includes but is not limited to stunt riding, racing, competitive use, or other abnormal use inconsistent with the intended purpose of the product.
- Improper installation, storage, or maintenance includes but is not limited to assembly, servicing, repairs, or adjustments performed in a manner that varies from the official instructions.
- Exposure to abnormal environments includes but is not limited to corrosion caused by weather conditions, excessive moisture, or chemicals.
- Use with incompatible equipment includes but is not limited to charging batteries with non-approved chargers, using the battery in non-specified equipment, or tampering with/breaking seals on the battery.
- Ordinary wear and tear/consumables include but are not limited to brake pads, rotors, tires/tubes, spokes, chains, chain rings, cassettes, and cranksets.
- Cosmetic damage includes but is not limited to surface finish deterioration, scratches, dents, and other aesthetic issues not affecting function.
(b) Products with altered, defaced, or missing serial numbers(if applicable); products reported as stolen; products not purchased in the U.S. or not delivered in the U.S.
(c) Third-party software or services.
- No Tie-In Sales Requirement
Use of non-Original parts, accessories, or services will not void this warranty. However, damage directly caused by such items is not covered. Birch may require use of Birch parts only when provided free of charge. See 16 C.F.R. §700.10.
- Implied Warranties
Birch does not disclaim implied warranties. To the extent permitted by law and because this is a Limited warranty, the duration of all implied warranties (including the implied warranties of merchantability and fitness for a particular purpose) is limited to the Warranty Period stated in Section 3. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.
- Limitation of Remedies; Incidental and Consequential Damages
To the extent permitted by law, Birch is not liable for incidental, special, indirect, or consequential damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.
- State Law Rights
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
- Dispute Resolution Options
You are not required to use arbitration or any informal dispute settlement mechanism to pursue rights under the Magnuson-Moss Warranty Act unless Birch provides a mechanism that complies with 16 C.F.R. Part 703 and clearly identifies it here. Birch does not require arbitration to obtain warranty performance. If Birch offers a voluntary dispute resolution program, details will be posted at the URL in Section 15.
- Transferability
This warranty applies only to the original consumer purchaser and is not transferable, unless required by applicable law.

- Governing Law
This warranty is governed by U.S. federal law and by the law of the state where the product is delivered to the consumer.
- Effective Date
This Limited Warranty applies to purchases made on or after the Effective Date shown above.
